1. Acceptance of Terms

By accessing and using ChoreSpark ("the Service"), operated by Zorath LLC ("Company", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). Your electronic acceptance, continued use, or payment for services constitutes your agreement to these Terms.

Age Requirements: You must be at least 18 years old to create an account. If you are under 18, a parent or legal guardian must create and manage the account on your behalf.

Capacity: By agreeing to these Terms, you represent that you have the legal capacity to enter into binding agreements in your jurisdiction.

2. Description of Service

ChoreSpark is a family task management platform that gamifies household chores and activities for children and parents.

  • Quest-based task management system
  • 7-day adventure packs with narratives
  • Reward systems and progress tracking
  • Photo proof submission and approval workflows

3. User Accounts and Responsibilities

Parents are responsible for creating and managing accounts for their children. Users agree to:

  • Provide accurate account information
  • Maintain the security of login credentials
  • Supervise children's use of the platform
  • Use the service only for lawful purposes

4. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data.

5. Subscription and Billing

Subscription Plans

ChoreSpark offers subscription-based access with the following terms:

  • Monthly ($4.99/month) or annual ($49.99/year) subscription plans
  • Additional children beyond the first incur extra charges (+$0.99/month or +$9.99/year)
  • All prices are in USD and may vary by jurisdiction due to local taxes
  • Subscription includes access to all standard features and quest packs

Free Trial Terms

  • 7-day free trial for new users with payment method required for verification
  • Free trials convert to paid subscriptions automatically unless cancelled during the trial period
  • You may cancel anytime during your trial with no charge
  • Trial period begins upon account creation, not first use
  • One free trial per user, household, or payment method

Billing and Renewal

  • Automatic renewal unless canceled before the end of current billing period
  • Billing occurs on the anniversary of your subscription start date
  • Failed payments result in service suspension after 7-day grace period
  • Account reactivation available within 60 days of suspension
  • Payment methods: Major credit cards, PayPal where available

Cancellation and Refunds

  • Cancellation takes effect at the end of the current billing period
  • Access continues until the end of the paid period
  • No refunds for partial billing periods unless required by law
  • EU/UK Users: 14-day cooling-off period for new subscriptions
  • Australian Users: Refunds available under Australian Consumer Law
  • Refunds for defective service or unauthorized charges processed within 30 days

Price Changes

We may modify subscription prices with 30 days advance notice via email and in-app notification. Existing subscribers maintain their current pricing until their next renewal cycle. Price increases exceeding 25% require explicit consent to continue service.

Taxes

Applicable taxes (VAT, GST, sales tax) are calculated at checkout based on your location. You are responsible for any additional taxes or duties imposed by your jurisdiction.

6. User Conduct and Prohibited Activities

Users agree not to:

  • Use the service for any unlawful purpose or in violation of these terms
  • Upload inappropriate, harmful, or offensive content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the service or servers
  • Use automated systems to access the service without permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Violate any applicable local, state, or international law

7. Intellectual Property Rights

All content, features, and functionality of ChoreSpark are owned by Zorath LLC and protected by copyright, trademark, and other intellectual property laws.

  • Users retain ownership of content they upload (photos, etc.)
  • Users grant us license to use uploaded content to provide the service
  • ChoreSpark name, logo, and design are our trademarks
  • Unauthorized use of our intellectual property is prohibited

8. Account Termination

Termination by Company

We may suspend or terminate accounts for:

  • Violation of these Terms of Service
  • Non-payment of subscription fees after grace period
  • Illegal, harmful, or abusive activity
  • Extended inactivity (18+ months for free accounts, 24+ months for paid)
  • Breach of security or unauthorized access attempts
  • Repeated violation of community guidelines

Termination by User

You may terminate your account at any time by:

  • Using the account deletion feature in settings
  • Contacting customer support with termination request
  • Canceling subscription (account remains active until end of billing period)

Effect of Termination

Upon termination:

  • Access to your account and data will cease immediately
  • Your data will be retained according to our Privacy Policy retention schedule
  • You may request data export before termination through our support channels
  • Paid subscriptions will not be refunded except as required by law
  • Outstanding payment obligations survive termination

Data Export: You have the right to export your data before termination. Requests must be made at least 5 business days before termination becomes effective.

9. Limitation of Liability and Warranties

ChoreSpark is provided "as is" without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or technical failures
  • User-generated content or third-party actions
  • Damages exceeding the amount paid for the service in the past 12 months

10. Governing Law and Jurisdiction

Governing Law

These Terms are governed by Delaware state law and applicable U.S. federal law, without regard to conflict of law provisions. For users in the European Union, nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Dispute Resolution

For U.S. Users: Disputes will be resolved through:

  • Good faith negotiation for 60 days
  • Binding arbitration under American Arbitration Association rules
  • Individual claims only (class action waiver applies)
  • Arbitration in Delaware or your state of residence

For EU Users: You may bring disputes in the courts of your EU member state or before the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For Other International Users: Disputes shall be subject to the exclusive jurisdiction of Delaware courts, unless prohibited by your local consumer protection laws.

Limitation Period

Any claim or cause of action must be filed within one (1) year after it arose, or it will be forever barred, except where prohibited by applicable law.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via in-app notifications or email at least 30 days before taking effect. Continued use after changes constitutes acceptance of modified terms.

12. Service Availability and International Use

ChoreSpark is operated from the United States. We make no representation that the Service is appropriate or available for use in all countries. You are responsible for compliance with local laws in your jurisdiction.

Export Controls: You agree not to export, re-export, or transfer the Service to any country where such export is prohibited by U.S. or international law.

Service Modifications: We reserve the right to modify, suspend, or discontinue any feature of the Service with or without notice, though we will provide reasonable advance notice for material changes affecting paid features.

13. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government actions, internet outages, or third-party service failures.

14. Assignment and Transfer

You may not assign or transfer your account or these Terms without our written consent. We may assign our rights and obligations under these Terms to any third party without restriction, including in connection with a merger, acquisition, or sale of assets.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the complete and exclusive agreement between you and us regarding the Service. These Terms supersede all prior communications and agreements.
